Open records tip #4: Three days
When submitting an open records request you want to know the law, who to contact, and be as specific as possible. The next important thing to keep in mind is the time frame associated with the agency's response.
TIP #4 - THREE DAYS
By Kentucky law, the office that receives an open records request is required to acknowledge and response within no more than 3 days. This is important. This three day period obviously starts from the day that the office receives the request, not the day that the request is sent.
The office is required to at least acknowledge the request even if it plans on denying the request, needs more time to fulfill the request, or is not the custodian of the request. This three day response time creates a marker for you in tracking your request.
If the office has not responded within the allotted time give them a call or send a follow up letter confirming that they received the request. If they are still uncooperative, then it may be time to take your request to the Attorney General.
